										<content:encoded><![CDATA[<p>January 25, 2017: Alphonse Ferent. 51, of Stoughton, Massachusetts, has died from an accident that occurred at the Stop &amp; Shop distribution center in Freetown, Massachusetts. A tractor-trailer pulled away from a loading dock, causing Ferent to fall between the truck and the loading dock.</p>
<p>Subsequently, a forklift that was being used to unload materials from the trailer fell on top of Ferent and crushed him. The Freetown Police and Fire departments arrived on the scene around 12:38 am and administered first aid to Ferent until an ambulance arrived. Sadly, the victim was pronounced dead upon arrival at the Charlton Memorial Hospital in Fall River.  The police and the Occupational Safety and Health Administration are investigating the accident.</p>

										<content:encoded><![CDATA[<p>The <a href="http://www.mass.gov/courts/court-info/appealscourt/">Massachusetts Appeals Court</a> has reversed a trial court’s dismissal of a Court Officer’s claim for ‘<a href="http://www.mass.gov/bb/fy2007h1/2007outsec/h23.htm">Assault Pay</a>’. The Court Officer had alleged in his action that he is entitled to ‘Assault Pay’ under a law granting additional compensation benefits to state employees injured by “acts of violence [by] patients or prisoners in his custody”.</p>
<p>The Court Officer had been assigned to a courtroom in the <a href="http://www.mass.gov/courts/court-info/courthouses/middlesex-newbury/middlesex-probate-family-court-generic.html">Middlesex Division of the Probate and Family Court</a>. When a case was called, eighteen to twenty people entered the courtroom with one of the litigants and began making statements directed at the judge from the gallery. The judge took a recess and requested additional court officers, as well as <a href="http://www.cambridgema.gov/cpd/">Cambridge police</a> officers, to assist subduing the crowd. Persons in the courtroom were directed to vacate or face arrest. Cambridge police then began arresting individuals who had refused to leave the courtroom. The Court Officer was injured while assisting in the arrest of an individual who refused to leave, and was taken to the hospital by ambulance. The Court Officer later filed an action against the Commonwealth to recover for his injuries.</p>
<p>The lower court subsequently allowed the Commonwealth’s <a href="http://www.mass.gov/courts/case-legal-res/rules-of-court/civil-procedure/mrcp56.html">motion for summary judgment</a>. The Appeals Court reversed and remanded, reasoning that the trial court incorrectly converted the<a href="http://www.mass.gov/courts/case-legal-res/rules-of-court/civil-procedure/mrcp12.html"> 12(b)(6)</a> motion to dismiss into a motion for summary judgment and failed to follow caselaw related to other similar statutes. Interpreting the ‘Assault Pay’ statute, the Appeals Court reviewed the Workers Compensation Act and other similar statutes, which contain similar language. Historically, these statutes have been interpreted broadly to accomplish their primary and beneficial functions.</p>

										<content:encoded><![CDATA[<p>The Securities and Exchange Commission has filed fraud charges in Federal Court in Miami, Florida against the owners and operators of Jay Peak Resort, a Vermont-based ski resort, and related businesses. The complaint alleges that millions of dollars were raised under the EB-5 Immigrant Investor Program.</p>
<p>According to the <a href="https://www.bostonaccidentinjurylawyer.com/files/2016/04/tram.jpg" rel="attachment wp-att-16276"><img fetchpriority="high" decoding="async" class="size-full wp-image-16276 alignleft" src="https://www.bostonaccidentinjurylawyer.com/files/2016/04/tram.jpg" alt="tram" width="281" height="179" srcset="https://www.bostonaccidentinjurylawyer.com/files/2016/04/tram.jpg 281w, https://www.bostonaccidentinjurylawyer.com/files/2016/04/tram-188x120.jpg 188w" sizes="(max-width: 281px) 100vw, 281px" /></a><a href="https://www.sec.gov/litigation/complaints/2016/comp-pr2016-69.pdf">complaint</a>, the main perpetrators were Ariel Quiros of Miami, and William Stenger of Newport, Vt., who raised in excess of $350 million from foreign investors on promises of green cards and returns on their invested monies. The money was to be used to construct ski resort facilities and a bio-medical research facility in Vermont.</p>
<p>The perpetrators promised that investor money would only be used to finance specific projects, but instead it is alleged that over $200 million was used for other purposes, $50 million of which Quiros used for personal expenses, including the purchase of a luxury condominium, income tax payments, and the acquisition of another Vermont ski resort, Burke Mountain, which he renamed Q Burke Mountain, and turned over to his son to manage.</p>

<p>Some of the diverted investor monies were used to build a 116 room luxury hotel at the base of Burke, which was scheduled to open for the 2016 winter season. However, because the general contractor was owed substantial sums, claimed to be over $ 3 million, it refused to permit the issuance of a Certificate of Occupancy for the hotel, and consequently the hotel never opened. Numerous employees were let go as a consequence.</p>
<p>It is alleged that Quiros was able to divert investor monies, at least in part due to the absence of regulatory oversight of the EB-5 Program by the federal government and the State of Vermont. Controls were later established, requiring investor monies to be escrowed, which may explain the more recent monetary shortfalls experienced by the projects.</p>
<p><a href="https://www.bostonaccidentinjurylawyer.com/files/2016/04/logo-skier.jpg" rel="attachment wp-att-16272"><img decoding="async" class="size-full wp-image-16272 alignleft" src="https://www.bostonaccidentinjurylawyer.com/files/2016/04/logo-skier.jpg" alt="logo skier" width="290" height="174" srcset="https://www.bostonaccidentinjurylawyer.com/files/2016/04/logo-skier.jpg 290w, https://www.bostonaccidentinjurylawyer.com/files/2016/04/logo-skier-200x120.jpg 200w" sizes="(max-width: 290px) 100vw, 290px" /></a>It is further alleged that Quiros used the services of an investment brokerage house, Raymond James &amp; Associates, to deposit and divert investor monies. Such practices, in certain instances, can give rise to claims by defrauded investors against those who may have knowlingly assisted the perpetrators. The SEC, and the court appointed Receiver, generally does not pursue these aiding and abetting claims, leaving investors to pursue such claims with their own legal counsel.</p>
<p>The author of this blog, Boston attorney the attorney, is currently pursuing such a class action claim in federal court in Boston, Massachusetts against the world’s largest bank, JPMorgan Chase Bank, on behalf of defrauded investors of the Millennium Bank Ponzi scheme.</p>

										<content:encoded><![CDATA[<p>January 25, 2016: Queshon Ivy, 43 years old, has died as the result of serious personal injuries sustained, after a vehicle driven by Melissa L. Benedict, 34, of <a href="https://www.bostonaccidentinjurylawyer.com/dorchester-massachusetts-perso">Dorchester, Massachusetts</a>, struck him as he was crossing the street on the way to work. The accident occurred early Wednesday Morning on January 15, at around 8:00 a.m. at the intersection of Washington and Harvard Street in Dorchester.</p>

<p>According to<a href="http://bpdnews.com/"> Boston Police</a>, Ivy was crossing the street to get to his job site, when Benedict struck him. Ivy was pronounced dead at the scene. Benedict fled the scene, but was apprehended 20 minutes later on Morten Street, 1 ½ miles away from the accident. According to Police, Benedict was driving a <a href="http://www.vhstrans.com/">VHS Transportation</a> van, but was not on the clock at the time. Benedict told police that she was adjusting the heat and lowering the sun visor, just before the collision occurred.</p>
<p>&nbsp;</p>
<p>Benedict was freed on $1,000 bail and had to surrender her driver’s license. She is facing charges of motor vehicle homicide and leaving the scene after causing personal injury and death.</p>

										<content:encoded><![CDATA[<p>January 13, 2016: Richard Tetreault, 84, of Bernardston, Massachusetts has died as the result of serious personal injuries sustained when he crashed into an oncoming car at the Exit 4 toll booth off on the Massachusetts Turnpike in<a href="https://www.bostonaccidentinjurylawyer.com/springfield-massachusetts-pers"> West Springfield</a>.</p>

<p>The accident occurred at 3:40 p.m. when Tetreault was taking the westbound exit. After experiencing a medical emergency, he struck another car on the ramp. Tetreault’s car then traveled over the median divider of both the east and west bound lanes, colliding with a vehicle moving eastbound. Three passengers were in the vehicle at the time of the accident; a 28 year old female from West Brookfield, MA, a 45 year old female from Belchertown, MA, and a 61 year old male from Ware, Maine.</p>
<p>&nbsp;</p>
<p><a href="http://www.mass.gov/eopss/agencies/msp/">Massachusetts State Police</a>, The <a href="http://www.townofwestspringfield.org">West Springfield Fire Department</a>, and emergency medical personnel were the first responders to the scene. Tetreault and the passengers from the other vehicle were transported to Baystate Medical Center in Springfield, where Tetreault was later pronounced dead.</p>
<p>&nbsp;</p>
<p>Neither the conditions, nor the names of the other victims have been released. State Police are continuing their investigation of the accident and no charges have been filed at this time.</p>

										<content:encoded><![CDATA[<p>December 23, 2015: Joe Brady, 71, of <a href="https://www.bostonaccidentinjurylawyer.com/taunton-massachusetts-personal">Taunton</a>, Massachusetts, has died as the result of serious personal injuries sustained when he was struck by a motor vehicle driven by Michael Burns, 33, also of <a href="https://www.bostonaccidentinjurylawyer.com/taunton-massachusetts-personal">Taunton</a>. The accident occurred at approximately 8:30 pm on Saturday, when Brady was crossing Route 27 in <a href="https://www.bostonaccidentinjurylawyer.com/stoughton-massachusetts-person">Stoughton</a>, returning to a Christmas tree lot he owns.</p>
<p><span id="more-16242"></span></p>
<p>Brady was transported by medical helicopter to <a href="https://www.bmc.org/">Boston Medical Center</a>, where he later passed away. The driver was not injured, and remained on the scene, where he was questioned by <a href="http://www.mass.gov/eopss/agencies/msp/">Massachusetts State Police Officers</a>. Police also performed a field sobriety test and determined that Burns was impaired. He was arrested and charged with operating a motor vehicle under the influence of drugs.</p>
<p>The State Police Collision Analysis and Reconstruction Section are continuing to investigate the accident with the help from the Motor Vehicle Homicide Unit of the Norfolk County District Attorney’s Office.</p>

<p>The driver of the car was a 58 year old woman from <a href="https://www.bostonaccidentinjurylawyer.com/somerville-massachusetts-perso">Somerville</a>, whose identity has not yet been released. She was not injured.</p>
<p>The <a href="http://www.mass.gov/eopss/agencies/msp/#.Vmhci_mDFBc">Massachusetts State Police</a> were the first to arrive at the scene, with the<a href="http://www.cityofboston.gov/fire/"> Boston Fire Department</a> and emergency medical personnel arriving shortly thereafter. The cause of the crash is currently under investigation by the State Police, and no charges have been filed at this time.</p>

										<content:encoded><![CDATA[<p>November 19, 2015: Fabricio Tavares, 21, of <a href="https://www.bostonaccidentinjurylawyer.com/brockton-massachusetts-persona">Brockton, Massachusetts</a>, has died as the result of serious personal injuries sustained after he was ejected from the passenger seat of his friend’s car.  The accident occurred at around 3 a.m. on Sunday, November 9, 2015.</p>
<p>Danielson Dacostatavares, 20, also of Brockton, was driving the vehicle north on Route 24 in <a href="https://www.bostonaccidentinjurylawyer.com/stoughton-massachusetts-person">Stoughton</a>, when he swerved right and collided with a rock ledge adjacent to the roadway.  Tavares was ejected from the car and then struck by six other vehicles.<span id="more-16238"></span></p>
<p><a href="http://mass.gov/msp">Massachusetts State Police</a> were the first to respond and found Tavares in the road. Paramedics arrived shortly thereafter and transported Tavares and Dacostatavares to <a href="http://www.goodsamaritanmedical.org/">Good Samaritan Medical Center</a> in Brockton, where Tavares was pronounced dead and Dacostatavares was treated for minor injuries.  Two other men involved in the crash were also injured.</p>
<p>Dacostatavares is facing multiple charges including motor vehicle homicide by negligent operation, operating under the influence of alcohol, and a marked lanes violation.  Dacostatavares has pleaded not guilty and is due back in court on December 8, 2015.</p>

										<content:encoded><![CDATA[<p>October 5, 2015: Gina Burdick, 48, of <a href="https://www.bostonaccidentinjurylawyer.com/worcester-massachusetts-person">Worcester, Massachusetts</a>, has died as the result of serious personal injuries when a vehicle driven by Daniel Depew, 29, of <a href="https://www.bostonaccidentinjurylawyer.com/ayer-massachusetts-personal-in">Ayer, Massachusetts</a>, struck her from behind. <p>Gina and George Burdick were unloading groceries from their car, when Depew’s sedan collided with them, dragging Gina down the street. Gina was pronounced dead at the scene. George was rushed to<a href="http://www.umassmemorialhealthcare.org/umass-memorial-medical-center"> UMass Memorial Medical Center</a>, in Worcester, where he remains in critical condition. Depew fled the scene, but was eventually apprehended one hour later, near <a href="https://www.wpi.edu/">Worcester Polytechnic Institute</a>.</p>
<p>Depew faces several charges, including Driving while intoxicated, vehicular homicide, and leaving the scene of an accident resulting in death. He was arraigned last Wednesday and is being held without bail under the so-called dangerousness statute, which keeps him in custody for 120 days. Depew is due back in court on October 27, 2015.</p>

										<content:encoded><![CDATA[<p>September 16, 2015: Matthew Roderiques, 24, of <a href="https://www.bostonaccidentinjurylawyer.com/fall-river-massachusetts-perso">Fall River, Massachusetts</a> suffered serious personal injuries and is in critical condition after being struck by a vehicle, late last Saturday night. <p>Members of the<a href="http://www.dartmouthpd.org/"> Dartmouth Police Department</a> and emergency medical personnel responded to the accident scene, and tended to Roderiques’ injuries. He was then transported to <a href="http://www.rhodeislandhospital.org/">Rhode Island Hospital</a>, where he remains in critical condition.</p>
<p>Police have stated that the driver has not been charged criminally. However, the crash remains under investigation by the <a href="http://www.dartmouthpd.org/">Dartmouth Police</a>, and the <a href="http://www.mass.gov/eopss/agencies/msp/#.VfmpABFVhBc">Massachusetts State Police</a>.</p>
