										<content:encoded><![CDATA[<p>Jay Hawthorne, who suffered from quadriplegia and other significant health issues, was admitted to Fox Subacute at Warrington.</p>
<p>He developed a rash on his inner thighs and scrotum, constipation and a urinary tract infection.</p>
<p>When his bowel distention increased, he was sent to a nearby hospital. However, he began vomiting and died on the way to the facility.  Hawthorne was survived by his parents. The Hawthorne estate sued Fox Nursing Home Corp., alleging wrongful death and survival.</p>
<p><span id="more-1571"></span>The estate claimed that the defendant hospital’s negligence in providing inadequate care, food and treatment, led to constipation, a perforated bowel and toxic megacolon.</p>
<p>Before trial, the parties settled for $400,000.</p>
<p>The attorney handling this tragic case for the estate was Andrew P. Watco.</p>

<p>Roberson was diagnosed as having a urinary tract infection of the kidney and severe sepsis. Despite undergoing aggressive treatment, she died nine days later. She was survived by her sister, Margaret.</p>
<p>Roberson’s estate sued Meadowbrook Healthcare LLC, alleging negligence and violation of the state’s <a href="https://codes.ohio.gov/ohio-revised-code/section-3721.13">Nursing Home Residents Bill of Rights</a>. The estate asserted that the nursing home facility was chronically understaffed and provided substandard care.</p>
<p><span id="more-1569"></span>After a trial, the jury signed a verdict for approximately $17.67 million.</p>

										<content:encoded><![CDATA[<p>Edward Jackson, 51, resided at the Claridge House Nursing &amp; Rehabilitation Center. He developed a wound on his left heel and allegedly received wound care from <a href="https://qsm.org">Quality Surgical Management Inc.</a> and its employee nurse for more than two months.</p>
<p>Jackson subsequently was transferred to a hospital where he was diagnosed as having anemia, sepsis and gangrene in his left foot. He required a below-the-knee amputation of his left leg.</p>
<p>Jackson’s representative sued Quality Surgical Management and the employee nurse, alleging medical (nursing home) negligence and vicarious liability.</p>
<p><span id="more-1555"></span>The Jackson lawsuit argued that the employee nurse chose not to treat his wound as a Stage IV wound, diagnose osteomyelitis and gangrene and properly supervise his wound care treatment.</p>
<p>After a jury trial, the jury signed a verdict for $1.64 million. The attorney representing Jackson was Tom Pennekamp.</p>

										<content:encoded><![CDATA[<p>Barbara Tucker, 68, suffered a broken ankle and kneecap in a fall at a rehabilitation facility.  After she was hospitalized, she entered <a href="https://lynchburghealthrehab.com">Lynchburg Care Center</a> where she suffered a fatal pulmonary embolism 11 days later.  She was survived by her four adult children.</p>
<p>The lawsuit against the care center facility brought by the family alleged that it chose not to administer Lovenox to Tucker, despite an order for the drug included in her hospital records.</p>
<p>In addition, the Tucker family alleged that the defendant rehab center failed to provide Tucker with her other medications during the first few days of her admission and never alerted her medical providers that she was not receiving her medicine.</p>
<p><span id="more-1553"></span>After a jury trial, the jury signed a verdict for $3 million.</p>

										<content:encoded><![CDATA[<p>Jean Vicoli, 93, was admitted to <a href="https://nursa.com/facilities/attleboro-nursing-and-rehab-ce-langhorne-pa">Attleboro Nursing and Rehabilitation Center</a> for rehabilitation following her fall, which resulted in a fractured femur and other injuries. A fall prevention care plan allegedly was put in place, including encouragement to call for assistance before moving about by walking.</p>
<p>The staff later noted that she was confused and had gait problems. She also had developed a sacral pressure sore.</p>
<p>Within a month of her admission, she fell twice. She suffered a traumatic head injury and fractured her arm. Vicoli’s pain increased, and her health continued to decline. She later died and was survived by her two children.</p>
<p><span id="more-1557"></span>The Vicoli estate sued Attleboro Associates Ltd. and Wilmac Corp., alleging their choosing not to implement proper fall prevention measures that would have alleviated or limited the possibility of Vicoli’s injuries and death.</p>
<p>Before trial, the parties settled for $150,000. The attorney representing the Vicoli estate was Christopher Culleton.</p>

										<content:encoded><![CDATA[<p>Helen Ende was 89 years old and suffered from dementia. While she was a resident at Parkside Manor, she was allowed, unnoticed, to wander off the premises and remain outside in the cold for almost seven hours before the nursing home staff realized she was missing. She froze to death. Ende is survived by her son.</p>
<p>Ende’s son, on behalf of her estate, sued <a href="https://parksidemanor-assistedliving.com">Parkside Manor</a>’s parent company, Encor Wisconsin LLC, alleging that its manager and staff disregarded Ende’s safety rights.</p>
<p>The Ende estate maintained that Encor’s policy required staff members to account for all residents after an alarm sounds. But on the night of Ende’s death, the three workers on duty chose not to follow this policy. The estate also alleged that one worker left the nursing home facility for multiple hours during his shift.</p>
<p><span id="more-1549"></span>After a jury trial, the jury signed a verdict for $4 million in punitive damages. The attorneys successfully handling this tragic matter were Benjamin Wagner and Molly Lavin.</p>

That same day, she was transferred to a hospital where she was treated for five days before being transferred to a different skilled nursing facility.</p>
<p>After her passing, her estate sued Creekside’s operator, alleging that it chose not to develop and implement an effective plan to treat Jarmon’s diabetes. The defendants’ negligence led Jarmon to suffer diabetic complications, delayed care and severe pain.</p>
<p>After a jury trial, the jury entered and signed a verdict for $347,100. The attorney successfully handling this lawsuit for the Jarmon family was Richard Piliponis.</p>

										<content:encoded><![CDATA[<p>Eleanor Kalai was admitted to <a href="https://www.stmaryrehabilitationhospital.com">St. Mary’s Rehabilitation Hospital</a> after having surgery for a fractured femur.  When she was admitted,  she was suffering from impaired cognition and required help with activities of daily living.</p>
<p>Approximately six months after her admission, she fell and dislocated her left shoulder.  She also fell out of her wheelchair approximately three weeks later in the presence of a facility employee.</p>
<p>Kalai’s estate sued St. Mary’s Rehabilitation Hospital, alleging that Kalai had been improperly monitored and assisted.  The lawsuit also claimed the defendant rehab hospital chose not to implement a fall prevention plan.</p>
<p><span id="more-1535"></span>The parties reached a settlement before trial in the amount of $261,500.</p>
<p>The attorneys successfully handling this cause for the Kalai estate were Jeffrey I. Zimmerman and Jeffrey D. Schmidt.</p>

The three workers who were on duty chose not to follow this policy and one worker left the building for a few hours during his shift.</p>
<p>Following trial, the jury signed a verdict for $4 million in punitive damages.</p>

She underwent surgery for a fractured hip and was admitted to Crestview Center. During her stay, she was immobile and required assistance with transfers and all daily activities. Early-stage bedsores were revealed on her right buttock and hip.</p>
<p>An unstageable pressure ulcer on her sacrum developed while hospitalized. Her physical condition deteriorated along with her wound, necessitating hospice care.  She passed away several weeks later.</p>
<p>She was survived by her daughter.  The McAleese estate sued <a href="https://www.genesishcc.com/crestview">262 Toll Gate Road Operations, LLC</a>, which did business at Crestwood, complaining of nursing malpractice along with claims under the state’s wrongful death and survival acts. The estate also claimed that McAleese suffered preventable pressure sores due to the negligent care, including choosing not to properly turn and reposition her.</p>
<p><span id="more-1525"></span>The parties settled for $150,000.</p>
