Landmark NYC Verdict Hailed as Socially Significant for Corporate Environmental Accountability

Chapman is a finalist for the 2010 Public Justice Trial Lawyer of the Year Award for his successful representation of New York City in a trial against Exxon Mobil Corporation. The City charged Exxon Mobil with poisoning it’s groundwater and drinking water supply with the gasoline additive methyl tertiary butyl ether (MTBE). After an 11-week federal court jury trial, which was the first of nearly 200 MTBE cases nationwide to go to trial, Chapman and his team obtained a $104.7 million compensatory damage award holding the oil company responsible for the groundwater contamination.

Sixteenth Street Medical Center LP has closed on a $28.7 million construction loan from US Bank, and will begin immediately on the development of a three-story 50,000 square-foot medical building in Santa Monica, California.

The financing, which was negotiated on behalf of the borrower by attorney Brian Kang of Los Angeles-based law firm Greenberg Glusker, allows the development team, led by Randall Miller of The Nautilus Group, Inc. to move forward on the build-to-suit for UCLA. UCLA signed a long-term lease in February to occupy the entire building, which will be used as an outpatient surgery facility.

Rights of Old Oil Do Not Trump Needs of New Residents; Related CEQA Lawsuit Against LA County Set for April 5th Trial

Greenberg Glusker today announced that the Los Angeles Superior Court has upheld the right of its client, the City of Culver City, California, to regulate expansion and intensification of new oil well drilling in order to protect its residents. In an order issued March 26, 2010, Judge James Chalfant rejected a challenge by an oil company, Plains Exploration & Production Company (PXP), which sought a writ of mandate invaliding the City’s moratorium on new drilling. The City had issued the temporary ban to allow it time to develop proper regulations of new wells and to address health issues, including concerns arising out of residents’ reports of noxious fumes originating in the Inglewood oil field in 2006.
