San Diego Auto Accident Kills One And Injures Four

San Diego Union Tribune's Debbie Baker and Susan Shroder reported that several members of a family were injured, one fatally in a car accident on April 25, 2012. The tragic accident happened at around 6:30 a.m. on Interstate 805 in Sorrento Valley as the Thomas family was on their way to Disneyland. According to CHP Officer Art Athans, an unnamed woman driving a Nissan Altima stated that the driver of a Honda sedan cut her off and as she swerved to avoid it, she hit the Thomas' Toyota Rav4 causing it to roll several times and come to rest hanging 30 feet above a Caltrans work site.

The Rav4 driver, 43-year-old Brian Thomas sustained multiple cuts, bruises and broken ribs. His wife Rebecca, 42, who was sitting in the front seat, was also injured. Their 22-year-old daughter Daniesha and 8-year-old son, who were in the back seat, received multiple injuries including cuts and bruises. However, their 66-year-old grandmother suffered a major traumatic brain injury. The family was rescued by construction workers and taken to a local hospital, where the grandmother later died from her injuries.

Applicable California Law

The driver and owner of the Nissan and the Honda, if they can be identified, would be liable to the Thomas family for violation of Vehicle Code Section 21658, which requires the drivers to remain within a lane until it is reasonably safe to move from their lane. In this case, the accident occurred when the driver of the Honda allegedly cutoff the Altima forcing its driver to swerve to avoid the Honda, which would constitute unsafe movements by both drivers . Bonsall Auto Accident Kills Escondido Man And Passenger

North County Times Teri Figueroa reported that an Escondido man and his passenger were fatally injured on April 15, 2012. The auto accident happened at around 10:30 a.m. on Highway 395 at Lilac Road in Bonsall. According to CHP officer Jim Bettencourt, the 68-year-old Escondido man driving a 1996 Honda Accord eastbound on Lilac pulled in front of a 2003 Ford Explorer heading north on Highway 395. The man was killed instantly and his female passenger was transported to Palomar Medical Center where she later died from her injuries. The 36-year-old driver of the Ford SUV and her 6-year-old daughter sustained injuries and were also transported to the hospital.

The Escondido man's estate will be liable for claims due to his violation of California Vehicle Code 21802, which requires the driver of a vehicle stopped at a stop sign to yield the right-of way to any vehicle approaching from another highway that is close enough to constitute an immediate hazard. San Diego Union Tribune's Jen Kuhney reported that a 25-year-old Marine stationed at Camp Pendleton was fatally injured in a auto accident around 1 a.m. on March 17, 2010. The unnamed Marine was a passenger in a 2005 Ford Mustang traveling north on Coast Highway near Michigan Street when the driver lost control of the vehicle and ran into a palm tree causing it to collapse on the vehicle. Both the driver and the Marine were taken to a local hospital where the Marine died from his injuries later that morning.

Ramona Motorcycle Accident Kills Carlsbad Man

North County Times Brandon Lowery reported that 57-year-old Dennis Williams of Carlsbad was fatally injured in an auto accident in Ramona while riding his motorcycle on March 4, 2012. The motorcycle accident happened around 12:30 p.m.. Williams was riding northbound on Highland Valley Road and was struck by a Honda Civic, which hit a Toyota Prius traveling southbound before hitting Williams and ejecting him from his bike. While rescue crews were in the process of airlifting him to a hospital he died from his injuries.

San Diego News 6 Mike Wille reported that 21-year-old Ashley Maya was arrested for allegedly driving under the influence and causing a fatal auto accident on February 12, 2012. According to the CHP, Maya was drunk and driving at a high rate of speed. As she attempted to merge from Highway 163 to Interstate 8, she overturned her vehicle, ejecting two of the three passengers, one of whom died at the scene. The two other passengers were injured and transported to a local hospital. Police arrested her on suspicion of gross vehicular manslaughter while intoxicated.

Maya will face felony criminal charges for violation of Vehicle Code 23152, which makes it illegal to drive while under the influence of drugs and or alcohol as well as Penal code 192, which makes it a felony when death or injury results from driving while intoxicated. Furthermore, Maya will be liable to the heirs of the passenger who was killed for wrongful death claims as provided by Code of Civil Procedure sections 377.60-377.62 as well as California Code of Civil Procedure sections 377.30-377.35 for a "survivor action" for any damages not covered by the wrongful death statute. San Diego News 10 reported that 44-year-old Grant Fisher of Escondido sustained serious injuries as a result of being hit by a car on January 19, 2012. The auto accident happened when Fisher was riding in the bike lane on Sorrento Valley Boulevard during his lunch. Police reported that 76-year-old Cecilia Cueva allegedly swerved to avoid a speeding truck behind her causing her to hit Fisher. Fisher was taken to Scripps Memorial Hospital where doctors said he may never walk again and will be there for the next month or longer.

San Diego News 10 reported that an unnamed 21-year-old man was seriously injured when his motorcycle collided with an automobile on January 31, 2012. According to San Diego police Officer Dino Delimitros, the auto accident happened in the Barrio Logan area at around 5p.m. when the motorcyclist who was eastbound on Main Street, struck a Chevrolet Monte Carlo, which was traveling westbound and was turning left onto Vesta Street. San Diego Union Tribune reported that 20-year-old Landen Swanson of Vista was taken off life support from injuries he sustained in an auto accident on January 9, 2012. According to sheriff's Sgt. Stephanie Guerra, the driver of the vehicle that hit him fled the scene, but later called police and told them he was involved in the incident. He was later arrested and criminal charges are pending.

Fox Business writer Susan Ladika reported that San Diego is ranked first among the nation's major cities for DUI citations. The report is based on statistics from Insurance.com from November 1, 2010 to October 31, 2011. Furthermore, it is the second year in a row San Diego leads the list. However, confounding factors such as lack of public transportation and vigilance by local police could account for the high ranking. Peter Moraga, spokesman for the Insurance Information Network of California, speculates that California leads in DUI citations because it is a "car-centric state," and law enforcement officials are "very attuned to the danger of driving under the influence." Valley Center Dog Attack Seriously Injures Joggers

San Diego News10 reported that 21-year-old Richard Garrison and his brother John, 20, of Valley Center were viciously attacked by a pack of Pit Bulls on November 27, 2011. The dog attack happened while the brothers and three family members were jogging on a trail near Cobb Lane and Lake Wohlford. The victims' brother Jarrod was quoted as saying, "My brother [Richard] said, 'I'll take care of the dogs.' "They basically were eating him while they kept going."
Jarrod believes that Richard saved the life of his 9-yeay-old daughter who was with the group. Both victims were flown to Sharp Hospital where Richard underwent surgery. According to the San Diego County Department of Animal Services all four dogs were impounded and euthanized at the request of the owner.

According to the report the dogs' owner could face criminal charges. Vista Man Dies In Oceanside Motorcycle Accident

San Diego Fox 5 News reported that 26-year-old Kristopher Murray of Vista died from injuries resulting from a motorcycle accident on November 12, 2011. The fatal auto accident happened at around 2:30 a.m. when Murphy was riding his Yamaha R1 motorcycle southbound on North Santa Fe Drive, allegedly at a high rate of speed. A Honda minivan traveling on Darwin Road made a left turn onto northbound North Santa Fe Drive causing Murray to run into the rear drivers side of the van. According to the Medical Examiners Office, Murray who was ejected from his motorcycle, was pronounced dead at the scene.

Applicable California Law

California Vehicle Code 21801(a) requires the driver of a vehicle intending to turn left to yield to opposing traffic, which is close enough to constitute a hazard. Thus, the driver of the van and the registered owner would be liable for any property damage as well as the wrongful death of Murray (see my prior Blog post for Wrongful Death Law In California). However, California Vehicle Code 21801(b) requires the driver of an approaching vehicle to yield to a turning vehicle, which has yielded to oncoming traffic and given a proper signal. Therefore, if further investigation determines that Murray was driving too fast and or failed to yield to the van, then any claims made by his heirs would be reduced in proportion to his contributing to his death.

San Diego News 10 reported that 56-year-old Insixiengmay and 59-year-old Tem Thirakul were fatally injured when the vehicle in which they were riding was struck by a Federal Express Tractor Trailer on October 13, 2011. The auto accident happened at around 10 p.m. when their Honda Civic, being driven by a 35-year-old woman, lost control and veered into the path of the truck as the car was entering Interstate 805 at Clairemont Mesa Boulevard. Both victims were pronounced dead at the scene and their driver was transported to Sharp Memorial Hospital. The California Highway Patrol is continuing to investigate the incident.

Escondido Woman Killed In Boating Accident

San Diego News 10 reported that 34-year-old Maricon Yeso of Escondido, her mother Aurora Yeso, 59, and Anesia Bautista, 47, were fatally injured in a boating accident on October 15, 2011. The three woman were riding on a Sea-Doo at Puddingstone Lake in San Dimas, when they were struck by a 21-foot powerboat causing their wrongful death. Four people in the boat also sustained injuries and were taken to the hospital. According to L.A. County sheriff Mike Rosen, witnesses say the boat hit the Sea-Doo when both were making high-speed turns and collided. The incident is under investigation, to determine who was at fault.

San Diego News 8 reported that an unidentified woman passenger in a Hyundai Sonata was fatally injured on October 8, 2011. The tragic auto accident happened at around 2:30 a.m. on state Route 78 and Bear Valley Parkway in Escondido, when 21-year-old Joshua Goldbaum of Escondido collided into a Ford Aerostar van. One of Goldbaum's passengers died, another was injured as well as the driver of the van. The passenger in the van, who sustained major injuries is expected to survive. According to CHP Officer Bettencourt, Goldbaum who fled the scene, was later arrested and taken to the Vista jail and faces numerous felony charges for hit-and-run, gross vehicular manslaughter and driving under the influence.
