May is Motorcycle Safety Month: Look twice for motorcyclists in Springfield

May is Motorcycle Safety Month, and our Springfield personal injury lawyers want to encourage all Missouri drivers to make motorcycle safety a priority - especially at this time of year, when more motorcyclists are on the road. A recent report from the Governors Highway Safety Association (GHSA) indicates that motorcycle fatalities increased by approximately 9% in 2012 - in fact, U.S. motorcycle deaths have increased in 14 of the past 15 years. During the same time period, fatal accidents involving all kinds of motor vehicles decreased by 23%.

So, what accounts for the increase in motorcycle fatalities? The GHSA report cites several possible contributing factors, including high gas prices (which prompted more riders to travel by motorcycle last year) and record-high spring temperatures (which extended the 2012 riding season in several states, including Missouri). However, all too many motorcycle accidents happen simply because drivers either fail to see riders traveling near them or fail to yield the right of way. In fact, in 2011, about 40% of fatal two-vehicle motorcycle accidents occurred when another vehicle turned left into a motorcyclist's path.

Consider these recent fatal motorcycle accidents:

• April 23; Verona, New York: Raymond Torres, 44, was killed when another driver failed to yield the right of way and pulled into the path of his motorcycle. Torres was ejected from his bike and pronounced dead at the scene. The other driver was ticketed for failing to stop at a stop sign.

• April 26; Westtown Township, PA: A suspected drunk driver failed to yield as he attempted to make a left turn, causing an oncoming motorcyclist to strike the passenger side of his truck. Liam Crowley, 24, was taken from the scene by ambulance and later died as result of his injuries. According to local police, the other driver has five previous DUIs on his record and was driving with a suspended license at the time of the crash.

• April 27; Chatsworth, California: A former U.S. Marine died when a car failed to yield to his motorcycle at an intersection. Lance Corporal Jesse Wilkes, 27, struck the right front door of a car that turned left in front of him. His family is currently working to have left-turn arrows added to intersections in the vicinity of the crash. Cpl. Wilkes had served two tours in Afghanistan.

Over the months ahead, we urge Springfield drivers to look twice for motorcycles, especially when turning, changing lanes or passing through an intersection. It only takes a moment, and it just might save someone's life.

Teen driver fatalities increase in early 2012: What can parents do to help?

During the first six months of 2012, car accident fatalities increased by 19% among 16 and 17 year-old drivers, according to a recent report from the Governors Highway Safety Administration (GHSA). As Springfield personal injury lawyers, we know that teens are already an at-risk age group when it comes to serious crashes, so the 2012 data is worrisome, to say the least. However, there's good news: research indicates that parental involvement has a significant impact on a young driver's behavior behind the wheel. "Parents play a key role in preventing teen crashes," says Erin Sauber-Schatz, Senior Researcher for the National Center for Injury Prevention and Control. "When asked whose opinions they listen to, teens most often said their parents."

Consider the following statistics, compiled by the Children's Hospital of Philadelphia:

     • Teen drivers are half as likely to crash and twice as likely to wear their seat belts when their parents "set rules and pay attention to their activities in a helpful, supportive way." These drivers are also 70% less likely to drink and drive and 30% less likely to use a cell phone while driving.

     • Conversely, teens who report having "easy access to the keys" are more than twice as likely to crash, compared to young drivers who share vehicles.

So, what are some specific actions parents can take to safeguard their young drivers? Here are a few basic steps to help you stay involved with your teens' driving education and reduce their accident risks.

     • Be a hands-on driving teacher. Under Missouri's Graduated Driver License Law, drivers must receive 40 hours of supervised instruction (including 10 hours of nighttime driving) to graduate from an Instruction Permit to an Intermediate License. Use the opportunity to help your teen build experience by practicing on different kinds of roads, at different times of day, and in different weather and traffic conditions.

     • Know what your teen is doing. Always ask where they're going, who they're going with, and when they'll be home - and hold them to their word! Teen drivers are more likely to take risks on the road when they're not being held accountable for their whereabouts and actions.

     • Develop a parent-teen driving agreement that's right for your family. Establish clear ground rules so your teen understands your expectations and the consequences of breaking the rules. (Click here to view a sample contract.)

     • Set a good example when you're behind the wheel. One of the best ways to teach your teen about safe driving is to be a model of good driving behavior. Buckle up, don't speed, and put your cell phone away.

     • Respect your teen's desire for independence. Many young drivers view obtaining a driver's license as an important milestone on the way to adulthood. Teens are more likely to be receptive to parental advice - and to comply with household rules - when they feel they are being treated with respect. Parents should stress that certain rules are in place to keep their teens safe, not to control their activities. It's also important to praise and reward your teen for behaving responsibly.

10 facts to know about car accidents in Springfield, Missouri & nationwide

Car accidents happen in a matter of seconds, but they can have devastating long-term consequences for victims and their loved ones. In this post, our Springfield personal injury lawyers discuss ten facts about motor vehicle crashes and common contributing factors.

Ten facts about car accidents for Missouri drivers:

1. The average American has a 30% chance of being involved in a serious motor vehicle crash at some point during their life.

2. Annually, more than 30,000 people are killed in U.S. car accidents. The U.S. Department of Transportation reports that the total societal cost of these fatal accidents is more than $200 billion each year.

3. Distraction is a leading cause of serious traffic accidents. A study conducted by Monash University found that drivers who use hand-held electronic devices are about four times more likely to be involved in crashes resulting in injuries.

4. According to the Insurance Institute for Highway Safety (IIHS), speeding was a contributing factor in 31% of 2011 auto accidents. Since 2002, speeding has played a role in about one-third of all traffic crash fatalities nationwide.

5. Nearly 30 people are killed every day in U.S. crashes involving drivers who are under the influence of alcohol - that's one death every 48 minutes.

6. Pedestrians accounted for about 14% of 2011 auto accident fatalities. Approximately 69,000 pedestrians were injured in car crashes and 4,432 were killed.

7. Younger and older drivers have an increased risk of involvement in accidents. Teens between age 16 and 19 have a higher crash risk than any other age group - in fact, they're three times more likely to crash than drivers over age 20. And the IIHS reports that 'per mile traveled, fatal crash rates increase noticeably starting at age 70-74 and are highest among drivers 85 and older."

8. Statistics suggest that men are more likely to be killed in car accidents than women. In 2011, men accounted for 70% of driver fatalities; 52% of passenger fatalities; 70% of pedestrian fatalities; 85% of bicyclist fatalities; and 91% of motorcycle fatalities.

9. About 24% of all motor vehicle crashes are weather-related, according to the Federal Highway Administration. A weather-related crash is defined as one that occurs in "adverse weather (i.e., rain, sleet, snow, and/or fog) or on slick pavement (i.e., wet pavement, snowy/slushy pavement, or icy pavement)."

10. The best way to protect yourself from car accident injuries is to wear your seat belt. Between 2006 and 2010, seat belts saved an estimated 69,000 lives.

Avoiding car accidents this spring: Tips for Springfield, Missouri drivers

Spring is finally here, and our Greene County personal injury lawyers know that many Missourians are looking forward to some relief from cold temperatures and wintry weather. However, a recent news release from the Missouri Highway Patrol asks drivers to remember that springtime also brings certain changes that can affect roadway travel. In this post, we discuss five useful safety tips for spring driving.

Spring driving safety tips for Missouri motorists:

• Use caution when traveling in unpredictable spring weather. As Springfield residents know all too well, springtime in the Ozarks can mean rain, sleet, hail, flash flooding, fog and widely varying temperatures, all of which can complicate roadway travel. When you encounter wet or slick roads, remember to slow down and increase your following distance. You'll also want to use your headlights and your defroster to help yourself see and be seen. Finally, avoid driving through large puddles, which can affect your brakes or cause you to hydroplane.

• Expect to see farming equipment on the road. With spring comes the planting season, which means more farming vehicles will be on the move. During the months ahead, drivers should expect to encounter these large slow-moving vehicles, especially on rural roads. Be sure to slow down and give them plenty of room, and be especially careful when passing. Remember that wide farming vehicles make extremely wide turns, so don't assume that a vehicle is moving to the right to allow you to pass. The driver may be preparing to turn left.

• Watch for increased recreational traffic. Missouri is home to a beautiful landscape, several rivers and lakes, and numerous state parks, so it's no surprise that many Ozarkers will be out enjoying the outdoors as temperatures continue to warm. Anticipate increased traffic, including local motorcyclists, bicyclists and pedestrians. Also, expect more cars and trucks on the road, especially over the weekends.

• Have your vehicle serviced. Many drivers "winterize" their vehicle to prepare for traveling in cold temperatures, but spring is also an excellent time of year to ensure your vehicle is in good working order. Replace your windshield wiper blades, check your headlights and your tire pressure, and chance your vehicle's cabin air filter (especially if you suffer from seasonal allergies).

• Make safe driving a priority. Taking a few basic safety precautions can help ensure that you and your passengers are protected in the event of a crash. Buckle up, put your cell phone away, and don't get behind the wheel if you've been drinking. It's common-sense advice, but it might just save someone's life.
Recent charter bus accidents cause passenger injuries, fatalities

Charter buses are a popular mode of transportation in Missouri and throughout the U.S., especially for high school and college students who are traveling to sporting or educational events. The companies that operate these buses have an obligation to ensure safe travel for their passengers, but, as our Springfield personal injury lawyers know, these buses don't always arrive safely at their destinations. Since February 27, there have been three serious accidents involving U.S. charter buses carrying college sports teams, and the most recent of these crashes had particularly tragic consequences.

The accident, which occurred on March 16 along the Pennsylvania Turnpike, left two people dead and several others injured. According to USA Today, the charter bus was carrying Seton Hill University's women's lacrosse team to a match in Millersville, PA at the time of the crash. The driver, 61 year-old Anthony Guaetta, reportedly veered off the road, struck an emergency call box and a guard rail, and then traveled about 70 yards before crashing into a grove of trees. Guaetta was pronounced dead at the scene, while three passengers were taken by helicopter to nearby hospitals. One of those passengers was team coach Kristina Quigley, 30, who was six months pregnant. Quigley and her unborn son were both pronounced dead shortly after arrival.

Authorities continue to investigate the circumstances surrounding the accident, though it could be weeks before they release their findings. In particular, they are working to determine what factors might have caused the driver to run off the road. "This [accident] occurred on probably the straightest stretch of turnpike anywhere in our system," said Bill Capone, spokesman for the Pennsylvania Turnpike. "There were no other vehicles involved. The suspicion is that something happened to the driver -- either he dozed off or there was a medical emergency."

However, Guaetta's autopsy indicates that he did not have a pre-existing medical condition, and he also tested negative for alcohol and drugs. In addition, investigators say both Guaetta and the bus were up-to-date on safety inspections. Guaetta was also wearing his lap and shoulder belt when the accident occurred, but law enforcement officials say there is no evidence that he attempted to brake or avoid the trees prior to impact.

In the week following the accident, one of the injured passengers filed a personal injury lawsuit against the bus company, Mlaker Transportation Inc. The Tribune-Review reports that the suit was filed by 18 year-old Amanda Michalski, who suffered numerous fractures and internal injuries in the crash. She remains hospitalized, but her condition has been updated to good. In the lawsuit, Michalski's attorneys argue that Guaetta was "negligent and reckless in the operation of the bus" and "failed to keep the bus under proper control." Michalski is seeking unspecified damages.

Share the road: Look twice for Missouri motorcyclists this spring

Today is the first day of spring, and recent weather forecasts indicate that warmer temperatures are on the way. It won't be long before drivers can expect to see Missouri motorcyclists back on the road in increased numbers. Since there's little to no motorcycle traffic during the winter months, many drivers have forgotten all about motorcyclists by the time riding season rolls around. In this post, our Springfield personal injury lawyers discuss five key points that other drivers should keep in mind when sharing the road with motorcyclists.

Risk factors & motorcycles: What other drivers should remember when traveling near riders

• Motorcyclists lack the protection of an enclosed vehicle. When accidents happen, passenger vehicle occupants are afforded a level of protection from a vehicle's outer structure and safety devices, which include air bags and seat belts. Since there's virtually nothing between a rider and the road, motorcyclists are extremely vulnerable to injury when they're involved in collisions. A collision with minor consequences for car occupants can have extremely serious implications for motorcycle riders.

• Motorcycles are less visible than cars. All too often, motorcycle accidents occur because a driver simply didn't see the motorcycle until it was too late to avoid a crash. Because they're smaller and narrower than other vehicles, motorcycles can easily disappear into blind spots or be obscured by objects on or along the road. Always look twice for motorcycles, especially when you're turning or changing lanes - it really might save someone's life.

• Motorcyclists must make sudden adjustments for roadway conditions and hazards. Being prepared for the unexpected is a key part of defensive driving for all motorists. However, common hazards like loose gravel, wet pavement, and uneven train tracks can be extremely dangerous for riders. For this reason, motorcyclists are often required to make sudden adjustments (like slowing down or changing lane position) when they encounter these conditions. Be alert when you're following riders, and expect them to make such adjustments as needed.

• Motorcycles are less stable than passenger vehicles when performing emergency maneuvers. Because the majority of motorcycles only have two wheels, they're trickier to handle than cars and trucks when they're forced to swerve or stop suddenly. Allow riders plenty of room, just in case an unexpected situation or obstacle presents itself.

• Motorcycles are entitled to the same rights and privileges as any other motor vehicle on the road. Accordingly, all motorists must treat motorcyclists with respect and courtesy. Treating riders like they're an annoyance or failing to respect their right of way increases your chances of causing or being involved in a serious crash.

Ride safe: Avoiding common Missouri bicycle accident scenarios

Recent research suggests that more and more Americans are using bicycles as their regular method of transportation, citing factors like economic benefits, health advantages and the impact on the environment. Since spring is nearly here, our Springfield personal injury lawyers want to encourage all motorists to share the road safely with bicyclists and advise cyclists to take precautions to avoid auto accidents.

Always wear a helmet: Click here to learn more about Aaron Sachs and Associates' Bicycle Safety Helmet Program

Avoiding Missouri bicycle accidents: Common scenarios in collisions involving bicycles and motor vehicles

Scenario 1: A driver pulls out of a side street or driveway on the right and either (1) strikes an oncoming cyclist or (2) pulls out in front of the cyclist, forcing the bicycle to strike the vehicle.
Avoiding this accident: It can be difficult for drivers to see bicycles coming straight towards them, so this kind of collision is fairly common. Be sure to ride with traffic rather than against it - after all, drivers won't be looking for traffic coming from the wrong direction. Also, using a headlight - even during the day - can help make cyclists more visible. If you're afraid a driver doesn't see you, consider waving your arm from side to side as you approach the vehicle - the side-to-side motion is easier for drivers to detect. And if all else fails, slow down enough so that you can stop if needed. It might be an annoyance, but it's far better to be annoyed than to be involved in an auto accident.

Scenario 2: A bicyclist moves slightly to the left to avoid a roadway obstruction and is rear-ended by a motor vehicle approaching from the behind.
Avoiding this accident: Don't shift into the traffic lane without checking for vehicles approaching behind you. Many cyclists use mirrors (attached to their handlebars, helmets or glasses) so they don't have to physically turn to check. Always signal before you move left, even if the movement is slight - some drivers don't allow extra space for cyclists, so shifting even an inch or two can put you at risk of being rear-ended.

Scenario 3: The driver of a parked vehicle opens his or her door right in front of an oncoming bicyclist.
Avoiding this accident: Unfortunately, this kind of collision happens frequently in metropolitan areas, where bike lanes tend to be placed as far to the right as possible. Cyclists use the term "door zone" to refer to the three to five-foot space in which a bicycle is in danger of being struck by a vehicle's door. To protect yourself, ride far enough to the left so that you won't be struck by a suddenly-opened door. It may mean that you have to ride in the traffic lane briefly, but you're less likely to be involved in an accident. Again, be mindful of other vehicles as you shift to the left.

Bicycle safety resources:

• The National Highway Traffic Safety Administration (NHTSA): Bicycles
• Missouri Bicycle and Pedestrians Federation
• BicycleSafe.com

At Aaron Sachs and Associates, our personal injury lawyers represent auto accident victims in Springfield, Missouri and throughout the surrounding areas, including Nixa, Ozark, Republic, Ash Grove Rogersville, Willard and Fair Grove.
Family of man killed in drunk driving accident awarded over $40 million in wrongful death lawsuit

When drunk drivers cause car accidents that injure innocent Missouri motorists, they may face numerous criminal charges and penalties associated with the accident. In addition, they may be subject to personal injury or wrongful death lawsuits that allow accident victims to recover compensation for their damages and losses. And, as our Springfield personal injury lawyers know, such losses can be immense.

Recently, an Alabama jury awarded more than $40 million to the family of a church music minister who was killed in a 2009 crash caused by a drunk driver. According to The Birmingham News, the award was granted in a wrongful death lawsuit filed by the widow and young son of 35 year-old Derric Rush, who was driving home from a Wednesday night church service when his vehicle was rear-ended and forced into a concrete barrier. Authorities say the other driver, 39 year-old James Kendrick, had been drinking in a nightclub parking lot and then continued drinking inside the nightclub in the hours before he decided to get behind the wheel. Kendrick was traveling over 100 miles per hour when he struck Rush's vehicle. His blood alcohol content was later found to be between 0.14 and 0.18%.

In addition to Kendrick, the lawsuit also named the nightclub, Club Volcano, as a defendant. Rush's family alleged that Kendrick and a companion "consumed most of a 750 ml bottle of Crown Royal liquor while sitting in a parked vehicle in the parking lot on the premises of the defendant, Club Volcano. Both of these men became intoxicated. It is believed that this practice was known, condoned and allowed by Defendant Club Volcano." A jury found in favor of the plaintiffs, ruling that the club must pay $37 million and Kendrick must pay $3.25 million in damages suffered by Rush's surviving family members. In 2011, Kendrick was also convicted of reckless manslaughter and is currently serving a 12 year prison sentence.

In the majority of wrongful death and personal injury cases involving drunk drivers, Missouri law follows "the common law rule that furnishing alcoholic beverages is not the proximate cause of injuries inflicted by intoxicated persons." However, accident victims may be permitted to take legal action against establishments that serve alcoholic drinks for consumption on the premises if one of two conditions applies:

• The seller "knew or should have known that intoxicating liquor was served to a person under the age of twenty-one years"; or
• The seller "knowingly served intoxicating liquor to a visibly intoxicated person."
Prepare for Missouri boating season: Take a boating safety course

Though today's weather makes it hard to believe, it won't be long before boating season is upon us here in the Ozarks. To promote safe boating and help prevent boating accidents, Missouri law requires certain individuals to pass a state-approved boating education course before hitting the water.

These individuals include:

• Operators who were born after January 1, 1984.

• Operators who have been convicted of certain boating offenses, which include boating under the influence of alcohol or drugs, negligent operation of a vessel, leaving the scene of an accident, and failing to yield to an emergency watercraft. Click here for more information.

Recently, Troop D of the Missouri Highway Patrol announced that boating safety certification courses will be offered to the public on the following dates:

• Saturday, April 23 at Cassville High School in Cassville, MO (9:00 a.m. to 4:00 p.m.)
• Saturday, April 20 at Troop D's headquarters in Springfield, MO (9:00 a.m. to 5:00 p.m.)
• Saturday, May 11 at U.S. Army Corp of Engineers Dewey Short Visitor Center in Branson, MO (9:00 a.m. to 5:00 p.m.

Boating safety certification courses: What Missouri boaters need to know

• You are required to pre-register online in order to take a course. Courses have a maximum size and may also be cancelled if there is not sufficient interest. Click here to pre-register, or to view a complete list of boating safety classes offered throughout the state.

• You must be present at the course in order to receive certification.

• The course is free. If you pass, you can order a boating safety certification card for $15.

• There is also an online boating safety course available, which is approved by the Highway Patrol. Click here for more information.

Boating accidents: The statistics

• According to the U.S. Coast Guard, there were 4,588 boating accidents nationwide in 2011. These accidents caused 758 deaths, over 3,000 injuries, and $52 million in costs associated with property damage.

• Here in Missouri, the Patrol says 19 people were killed and 86 people were injured in 2011 boating accidents.

• Of 2011 boating accident deaths nationwide, 70% drowned, and of that number, 84% were not wearing life jackets.

• Only 11% of boating accident fatalities nationwide occurred on boats where the operator had received boating safety training.

• The Coast Guard reports that the top five contributing factors in boating accidents are as follows: operator inattention, improper lookout, operator inexperience, excessive speed and equipment failure.
Driving under the influence: The risks facing Missouri motorists

Despite increased awareness about the dangers of driving under the influence, alcohol continues to be a contributing factor in many Missouri auto accidents - as our Springfield personal injury lawyers know all too well. In 2012, 217 people were killed and 815 were injured in Missouri traffic crashes involving an impaired driver.

Recently, a Purdy man was sentenced to 20 years in prison for causing a drunk driving accident that killed an 11 year-old girl and injured two others. The Missouri Highway Patrol reports that 28 year-old Gregory Swaffar was under the influence of alcohol in February 2011 when he crossed the center line of Highway 37 in Barry County and hit another vehicle head on. The driver of the that vehicle, 33 year-old Kenneth Keif, and his 11 year-old daughter Melissa were both airlifted from the scene of the crash. Melissa later died as a result of her injuries. Swaffar was not hurt in the crash, but his passenger, 46 year-old Sandra Larson, was also seriously injured.

In January, Swaffar pleaded guilty to driving while intoxicated, involuntary manslaughter, and two counts of second-degree assault. Then, this week, a judge sentenced him to 20 years in jail on the involuntary manslaughter charge and five years for each count of assault. Swaffar will serve the terms concurrently. Following the fatal accident, authorities discovered that Swaffar had two previous convictions for driving under the influence within the previous year, one of which was for "excessive blood alcohol content." In 2011, Kenneth Kief also won a $1 million dollar settlement in a personal injury and wrongful death lawsuit against Swaffar.

Drunk driving facts & statistics

• Predictably, a driver's chance of causing a collision increases exponentially as his or her blood alcohol content (BAC) rises. Research indicates that drivers with any alcohol in their bloodstream are seven times more likely to be involved in a crash than drivers with no alcohol in their blood. Drivers who reach the legal limit for intoxication (0.08%) are 13 times more likely to cause an accident.

• According to the Centers for Disease Control, about 30 people are killed in U.S. auto accidents involving a drunk driver, which means a drunk driving death occurs every 48 minutes.

• The National Highway Traffic Safety Administration estimates that one out of three Americans will be involved in an alcohol-related crash within their lifetimes.

• Consuming alcohol has a negative effect on several essential driving skills, including judgment, concentration, comprehension, coordination and reaction time.
"Secondary tasks" divide drivers' focus, cause Missouri car accidents

As Springfield personal injury lawyers, we know that distractedness is a common contributor to car accidents in Missouri and throughout the United States. While many drivers assume that driver distraction always involves cell phone use, there are actually numerous "secondary tasks" that can have a negative effect on driving performance. In this post, we share five of the most common driver distractions.

Eyes off the road: Five dangerous driving distractions

1. Using cell phones and other handheld electronic devices. By now, most people know that talking or texting while driving reduces a driver's ability to assess roadway situations and respond to them safely. Texting drivers are 23 times more likely to cause a crash than non-texting drivers, and using a cell phone - whether handheld or hands free - impairs a driver as much as having a blood alcohol content of 0.08%. The bottom line? Put your phone away when you're behind the wheel, and appoint a passenger to answer any texts or calls that require an immediate response.

2. Reaching for objects inside the vehicle. While many drivers don't immediately associate this task with the problem of distracted driving, it is an extremely common form of driver distraction. You take your eyes off the road (just for a moment!) to reach for a cell phone, a sandwich, or an object that's fallen into the floorboard. However, that "moment" of attention can be vital: at 55 miles an hour, a vehicle can travel half a football field in a matter of four seconds. It's extremely dangerous to take your eyes off the road even momentarily, and especially so when traffic is congested.

3. Looking at something outside the vehicle. External distractions - such as auto accidents, billboards, and even the scenery - can draw a driver's full attention away from the road. In particular, it's very common for a Missouri driver to cause a crash because he or she is looking at the aftermath of an earlier wreck. Resist the temptation to shift your focus to a non-driving related object or event.

4. Reading. Whether it's a text message, a map, or a newspaper, reading while driving can have catastrophic consequences. At a minimum, reading takes your eyes off the road and your mind off the task of safe driving - and depending on what you're reading, your hands may also be off the wheel. If you're behind the wheel and you need to read something immediately, find a safe place to pull over.

5. Grooming/putting on makeup. Applying makeup is another disturbingly common form of driver distraction. According to a study from the Virginia Tech Transportation Institute (VTTI), touching up your makeup while driving makes your crash risk about three times higher.
Semi-truck driver sued for wrongful death after striking bicyclist, leaving scene

In 2011, car accidents caused 32,667 deaths nationwide, including 786 deaths that occurred here in Missouri. As Springfield personal injury lawyers, we know that the aftermath of a fatal car accident is a traumatic, overwhelming time. When someone is killed as a result of another driver's negligence, fault, or misconduct, surviving family members may be able to file a wrongful death lawsuit against the responsible party.

Recently, a Massachusetts family filed a wrongful death lawsuit against a semi-truck driver who struck and killed a bicyclist in 2012. According to the Boston Globe, the suit was brought by the widow of 41 year-old Alex Motsenigos, who was training for a triathlon when he was hit by the semi and pulled under the vehicle. Authorities say the truck driver, 51 year-old Dana McCoomb, drove away following the collision. When McCoomb was later located by police, he said he heard about the accident but denied that he struck anyone.

The wrongful death lawsuit names McCoomb, his employer, and the company that owned the truck he was driving. It alleges that McCoomb was driving recklessly on the day of the accident, labeling him an "extremely dangerous driver who should not have been behind the wheel of a truck." McCoomb reportedly has a lengthy history of driving offenses: since 1982, his license has been suspended 19 times, and he was required to enroll in a National Safety Council driver retraining program in 2010. His license was ultimately revoked after the accident involving Motsenigos. In a statement, the Motsenigos family claims that "if the truck driver had used even basic care in operating the truck that struck Alex down, the accident would have been avoided and Alex would be alive today."

The lawsuit was filed about a week before a grand jury declined to indict McCoomb on charges of motor vehicle homicide by negligent operation, unsafe overtaking of a bicyclist, and failing to take precautions for the safety of other travelers.

A wrongful death claim is a civil action, completely separate and independent from any criminal charges associated with a death. When someone dies as a result of another individual's negligence or misconduct, certain surviving family members may be entitled to compensation for their losses and damages, which may include:

• Medical and burial expenses
• The deceased's future lost wages
• The deceased's lost benefits (insurance, pension, 401K, etc.)
• Loss of care or companionship
• Pain and suffering

Wrongful death lawsuits must be filed within a specific time period, known as the statute of limitations. If you have lost a family member in a car accident caused by a negligent driver, we encourage you to contact a personal injury lawyer as soon as possible to discuss your legal rights.
Driver inattention a common cause of Missouri school bus accidents

School buses are built to provide students with the maximum possible protection in the event of a crash, and thankfully, Missouri school bus accidents resulting in injury aren't particularly common. However, when school bus occupants are injured in a collision, it's often because of the actions of the driver, not because of the bus itself. Indeed, driver error is a leading cause of school bus accidents in Springfield and throughout the United States.

Factors that contribute to school bus driver error may include fatigue, poor training, impairment, and, notably, inattention or distractedness. For obvious reasons, distraction can be an occupational hazard for school bus drivers. In a 2010 survey on the safety concerns of school bus drivers, the Transportation Research Board found that "93% of the respondents [indicated] that student passengers' behavior was distracting to the driver." If other forms of distraction are also present - like cell phone use, for example - the situation can be ever more dangerous.

This week, 42 people were reportedly injured when a school bus driver rear ended another bus in Covington, Georgia. The Newton Citizen reports that the first bus had slowed to drop off a child when the second bus struck it from behind. The two bus drivers and 40 students onboard the buses were taken to local hospitals with various injuries, but none were reportedly life-threatening.

In the days that followed, authorities inspected the second bus and examined the crash site to determine whether or not mechanical failure contributed to the collision. They found that the bus was in good working order and the likely cause of the crash was driver error. "The mechanical inspection and the braking (skid) marks left by the bus on the roadway at the collision site eliminate the failure of the braking system or other mechanical defect as the cause of the collision," Sherri Davis-Viniard, Director of Public Relations for the Newton County School System, told the Citizen.

The bus driver, who is currently on medical leave, faces disciplinary action and criminal charges. We don't yet know what factors may have prevented her from stopping in time to avoid the crash, but we do know that driver inattention can pose a serious threat to students' safety. Distraction was a key topic at the National Association for Pupil Transportation Summit, held in October 2012. At the Summit, attendees heard a presentation that focused on driver inattention and a Missouri school bus driver who struck a six year-old boy. The driver was dealing with a commotion as the boy got off the bus, and he simply lost track of where the boy was. "I believe when we get into a routine, we can lose our focus on what we are doing," the former bus driver said in a safety video. "That accident changed my life and caused a lot of heartbreak and sorrow for [the boy's] family."

Facts about school bus crashes:

• Every school year, American school buses carry an estimated 24 million students and collectively travel more than four billion miles.

• Between 2000 and 2009, 1,386 people have been killed in school transportation-related crashes in the U.S., resulting in an average of 139 fatalities each year, according to the National Highway Traffic Safety Administration.

• Of those deaths, 8% were the occupants of school transportation vehicles and 20% were non-occupants like pedestrians and bicyclists. The other 72% were the occupants of the other vehicles involved in the collision.

Traumatic brain injuries can cause long-term consequences for Missouri car accident victims

According to the Centers for Disease Control (CDC), an estimated 1.7 million people suffer traumatic brain injuries (TBIs) in the United States, and TBIs contributed to approximately one-third of all injury-related deaths. As our Springfield personal injury lawyers know, auto accidents are a leading cause of these debilitating injuries. In this post, we share a few facts and statistics concerning TBIs and the long-term effects they can have on injury victims.

Traumatic Brain Injuries: Facts for Missouri Car Accident Victims

• TBIs are caused by bumps, blows or jolts to the head, which commonly occur in motor vehicle collisions. There are two basic types of TBIs: penetrating head injuries, where a foreign object enters the brain; and closed head injuries, where the brain strikes the inside of the skull.

• All TBIs are different, depending on the circumstances that caused the injury, the severity of the injury, and the area of the brain that's been damaged. Accordingly, the symptoms and effects also vary widely from patient to patient.

• Symptoms of TBIs can include loss of consciousness, poor memory, headaches, dizziness, confusion, blurred vision, nausea, impaired speech, insomnia or sleep disruption, ringing in the ears, and emotional changes.

• TBI symptoms may not appear until days or even weeks after an injury occurs, so it's essential to seek medical treatment immediately following a head injury, even if you think you feel find.

• The Brain Injury Association of America reports that TBIs "can change the way a person thinks, acts, feels, and moves the body. Brain injury can also change the complex internal functions of the body, such as regulating body temperature; blood pressure; bowel and bladder control. These changes can be temporary or permanent." The CDC concurs, pointing out that TBIs can result in several long or short term changes in a victim's thinking, sensation, language and emotion.

• TBIs can also be accompanied by numerous psychological challenges, including anxiety, anger and depression. They can also increase a victim's chances of developing additional neurological conditions, including epilepsy, Alzheimer's disease, Parkinson's disease, and other brain disorders.

• When injury victims sustain repeated mild TBIs over a period of several months of years, those patients can experience "cumulative neurological and cognitive deficits," according to the CDC. Sustaining multiple TBIs within a period of hours, days, or weeks can cause permanent, even fatal damage.

• Victims of TBIs can require extensive medical treatment in the present and long-term. This treatment may involve medication, injections, physical rehabilitation and occupational therapy. Many also require surgical procedures: The National Institute of Neurological Disorders and Stroke reports that approximately half of patients who suffer severe TBIs "will need surgery to remove or repair hematomas (ruptured blood vessels) or contusions (bruised brain tissue)."

Speed-related car accidents in Springfield, Missouri: The costs and consequences

When Missouri drivers exceed posted speed limits, they increase car accident risks for both themselves and for any motorists traveling near them. In this post, our Springfield personal injury lawyers discuss the way speed impacts roadway safety.

Why do drivers speed?

Research from the National Safety Council (NSC) indicates that many drivers cite speed as a specific threat to roadway safety. However, many of those same drivers also admit to exceeding the speed limit on a regular basis. Here are a few reasons why:

• They're in a hurry, running late, or feeling impatient with traffic.
• They're not paying attention to the speedometer.
• They don't feel like traffic laws apply to them.
• They don't feel that speeding is dangerous.
• They don't believe they'll be caught.

How does speed affect car accident risks?

A driver's stopping distance can be calculated by combining reaction distance (the time it takes to realize you need to brake and move your foot to the brake pedal) and braking distance (the time it takes your vehicle to slow and stop). The average driver requires about 1.5 seconds to react - and at 60 miles per hour, a vehicle travels approximately 132 feet during that short period of time. The faster you're moving, the less time you have to react and respond to roadway obstacles.

In addition, speeding increases the energy associated with a crash, which is dangerous because most vehicles are built to protect occupants at low speeds. According to the Insurance Institute for Highway Safety (IIHS), "there are limits to the amount of crash energy that can be managed by vehicles, restraint systems and roadway hardware such as barriers and crash cushions. The higher the speed, the higher the likelihood that these limits will be exceeded in crashes, limiting the protection available for vehicle occupants." For instance, if impact speed rises from 40 miles per hour to 60 miles per hour, the crash energy rises by 125%.

What are the consequences of speeding?

The consequences of exceeding the speed limit can be numerous and far reaching, including the following:

• Car accident fatalities. Annually, more than 13,000 people are killed in U.S. car accidents where speed is cited as a contributing factor.

• Construction zone accidents, injuries and fatalities. In 2011, speed was one of the top five factors contributing to car accidents in Missouri construction zones. These accidents killed 11 people and injured an additional 701. Under Missouri law, drivers who speed in work zones are subject to increased fines.

• Hazardous school crossing zones. During school hours, speed limits are reduced in school zones because slower speeds reduce the number and severity of pedestrian and bicycle accidents. Traveling through a school zone at high speeds can prove to be fatal. Missouri drivers who are ticketed for speeding in school zones are also subject to increased fines.

• Numerous costs and expenses. The NSC estimates that "every minute 'gained' by speeding to a destination costs U.S. society over $76,000." Each year, speed-related accidents result in more than $40 billion in costs.

If you or a loved one has been injured in a crash caused by another driver's negligence, it may be in your best interest to seek legal advice.
