Fairfield Auto Accident – DUI suspected

I’m Ed Smith, a Fairfield Auto Accident Lawyer. Operating a vehicle under the influence of alcohol puts everyone on the road at risk, including you and your passengers.  On Tuesday, May 31, 2016, two women were injured following a two-vehicle automobile accident near Fairfield, California, where alcohol may have been a factor.

What Happened?

The collision took place near I-80 and Highway 12 when the driver of a Lexus RX 350 rear-ended a 2006 Honda Civic.  In this instance, it was the driver of the Honda Civic, the vehicle that was rear-ended, that was suspected of driving under the influence.  Further details such as who actually caused the accident are unknown at this time.  Both drivers were transported from the scene for medical treatment.  The driver of the Honda Civic, who was arrested for suspicion of driving under the influence, was described as having “major injuries.”  The driver of the Lexus sustained minor injuries.

Punitive Damages in Auto Accidents

In California, driving a non-commercial motor vehicle with a blood alcohol content equal to or greater than .08 is illegal.  In addition to being a crime, causing an automobile accident and injuring other motorists while under the influence may expose you to punitive damages in a lawsuit stemming from the accident.  Punitive damages are specifically meant to punish the wrong-doer and to deter others from making the same mistake.  Punitive damages, while not an available damage under most auto accident scenarios, can be asserted in instances where the at-fault driver was operating an automobile under the influence of alcohol.
